Whoever without authority makes, uses, offers to sell, sells, or imports into the United States any patented invention infringes the corresponding patent. In an infringement suit, both damages and injunctive relief are available as remedies to a successful patent owner. Patents may be invalidated or rendered unenforceable, however, on a number of grounds including public use or sale, obviousness and inequitable conduct. This presentation discusses the major legal issues involved in asserting and defending against a patent infringement lawsuit.
