Recent changes in U.S. patent law have made it more difficult for inventors to obtain patents on their discoveries. Additional changes such as those under consideration in Congress and others recently proposed by the U.S. Patent Office will if enacted make getting a patent tougher still. To conserve resources in an entrepreneurial setting and have the best chance of getting a patent, it is important to be aware of these changes. Several strategies, some unique to chemical discoveries, are available that will forestall or mitigate the effects of these changes. The successful inventor will implement these strategies even before the patent application is drafted and filed. This tutorial will surely (well…okay, hopefully!) entertain and enlighten the viewer on some fundamental aspects of patent law and the usefulness of patents, the effects of the recent changes, and strategies for dealing with the changes and getting a patent allowed.
