It is rare that a new composition of matter leaps the hurdle of clinical approval with robust patent life remaining. Sometimes the composition of matter patent life is gone even before the clinical trials begin. A discussion will be provided of the approaches to building a portfolio and managing patent life based on use patents, polymorph patents, stereoisomer patents, formulation patents, and combination patents. Differences in the U.S. and major foreign jurisdictions will be included in the discussion.
